1. Introduction

Welcome to Surveh ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of the Surveh platform, including our website, services, and applications (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Services.

2. Canadian Jurisdiction

Surveh is a Canadian company, and these Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any dispute arising from these Terms or your use of the Services will be resolved exclusively in the courts of Ontario, Canada.

Our Services are designed to comply with Canadian laws and regulations, including the Personal Information Protection and Electronic Documents Act (PIPEDA).

3. Account Registration

To use certain features of our Services, you may need to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Subscription and Payments

Some of our Services require payment of fees. All fees are stated in Canadian dollars and are exclusive of any applicable taxes unless otherwise stated.

You agree to pay all fees in accordance with the billing terms in effect at the time a fee is due. If you provide credit card information, you authorize us to charge your credit card for all fees incurred.

Subscriptions automatically renew unless cancelled at least 30 days before the end of the current billing period. You may cancel your subscription at any time through your account settings or by contacting us.

5. Data Storage and Processing

All data collected through our Services is stored exclusively on Canadian servers. We do not transfer your data outside of Canada, ensuring compliance with Canadian data sovereignty requirements.

You retain all rights to your data. We will only use your data as described in our Privacy Policy and as necessary to provide the Services to you.

6. User Content

Our Services allow you to create, upload, and share content, such as surveys, forms, and responses ("User Content"). You retain ownership of your User Content, but you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, and display your User Content solely for the purpose of providing the Services to you.

You are solely responsible for your User Content and the consequences of sharing it. You represent and warrant that you have all necessary rights to your User Content and that it does not violate these Terms or any applicable law.

7. Prohibited Conduct

You agree not to:

  • Use the Services in any way that violates any applicable law or regulation
  • Use the Services to collect sensitive personal information without appropriate consent
  • Impersonate any person or entity or misrepresent your affiliation with a person or entity
  • Interfere with or disrupt the Services or servers or networks connected to the Services
  • Attempt to gain unauthorized access to any part of the Services
  • Use the Services to send unsolicited communications or promotions
  • Use the Services to collect or harvest personal information about others without their consent

8. Intellectual Property

The Services and all content, features, and functionality thereof, including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof, are owned by us, our licensors, or other providers and are protected by Canadian and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

These Terms do not grant you any right, title, or interest in the Services or our content, nor any intellectual property rights.

9. Termination

We may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Services will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

10. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICES OR THE SERVERS THAT MAKE THEM AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES.

12. Changes to Terms

We may revise these Terms from time to time. The most current version will always be posted on our website. If a revision, in our sole discretion, is material, we will notify you via email or through the Services. By continuing to access or use the Services after revisions become effective, you agree to be bound by the revised Terms.
